Terms and Conditions

The terms and conditions stated herein constitute a legal agreement between property management company Realty Co-host and you (the client). By receiving the services of Realty Co-host, you acknowledge and agree to be bound by the terms and conditions of this Agreement as well as future amendments and additions.

Realty Co-host responsibilities

  • Manage the property’s listing including posting appropriate photographs, writing property descriptions and house rules, responding to inquiries, accepting/rejecting prospective guests, and leaving reviews.
  • Coordinate property care and maintenance
  • Coordinate property inspection between stays to assess damage/theft etc.
  • Coordinate emergency services such as plumbing, electrical etc.
  • Create a property guide.
  • Act as point of contact for guests.
  • Ensure property is fully stocked.

Exclusions

  • Act as a co-host.
  • Undertake services like acting as point of contact or making inspections for reservations made outside the Airbnb website.

What We Expect Clients to Do

Be responsible for notifying mortgage lender of intent to list property on Airbnb. Contact insurance company of intent to list property on Airbnb with a property rental company and handle all required insurance policies.

TERMINATION OF AGREEMENT

How to Terminate the Agreement

If you choose to terminate the agreement, notify Realty Co-host in writing in advance. Note that existing bookings must be honored. Existing bookings will also be billed a ………% fee to cover the cost of labor and expenses.

The agreement may be terminated at any time by either party by giving …… days’ notice. Upon termination, Realty Co-host shall disburse the client any monies in its possession due within …… days from the date of termination. The client shall reimburse Realty Co-host for any expenses incurred or approved prior to the date of termination within …… days from the date of termination.

Representation

Both parties confirm that they are fully authorized to enter into this agreement. The obligations of either party will not violate the rights of any third-party or any other agreement between the parties and any other person, organization, business, law or governmental regulation.

Dispute Resolution

Any dispute arising between Realty Co-host and client must first undergo mediation prior to seeking court action. If either party refuses to mediate, that party will not be entitled to recover attorney fees. If both parties agree to mediate, they shall be entitled to recover reasonable attorneys’ fees and costs incurred in connection with those efforts.

Indemnity

Both parties agree to indemnify the other party and its affiliates, agents, employees, and permitted successors and assigns against any claims, losses, damages, liabilities, penalties, expenses, legal fees and costs of any kind or amount resulting from the negligence of or breach of this agreement by the indemnifying party, its successors and assigns that occurs in connection with this agreement. This section will remain in effect even after termination of the agreement.

JURISDICTION:

The agreement shall be governed by the state/country in which the property is located.
